TERMS OF SERVICE

1. Overview

This website is operated by Oswin Hyde ("we", "us", "our"). By using our site or purchasing from us, you agree to these Terms of Service and our related policies (Shipping, Returns, Privacy).

If you do not agree to these Terms, please do not use our website.


2. Using Our Online Store

By using our site you confirm that:

  • You are at least 18 years old, or

  • You have permission from a legal guardian.

You agree not to misuse the site or violate any applicable laws.


3. Product Information

We work hard to ensure product details and images are accurate, but minor variations may occur. We may update product information at any time.


4. Prices & Service Changes

Prices may change without notice.
We may modify or discontinue any part of the service at any time.


5. Delivery, Safe-Place Policy & Liability (IMPORTANT)

5.1 Delivery Responsibility Under UK Law

Under the Consumer Rights Act 2015, we remain responsible for your parcel until it is delivered to the address you provided.

Delivery is considered complete when:

  • The courier provides GPS-verified delivery, and

  • A photo of delivery is supplied as proof.

5.2 Safe-Place Deliveries & Flats

Modern courier practice (Royal Mail, Evri, DPD, etc.) allows parcels to be left:

  • At the door,

  • Inside communal lobbies,

  • With neighbours,

  • In safe places (if considered reasonable by the courier).

These are industry-standard delivery methods unless the customer opts out.

5.3 Customer Responsibility

To protect your parcel, you must ensure your delivery address is suitable for unattended delivery.

We strongly advise selecting DPD Click & Collect if:

  • You live in a building with a shared entrance

  • Parcels cannot be safely left outside your door

  • You may be unavailable at the time of delivery

This option is highlighted on our website and available at checkout.

5.4 If a Parcel Is Marked as Delivered

If the courier provides:

  • GPS proof of delivery, and

  • A delivery photo showing the parcel at your address or safe place

…then the parcel is considered successfully delivered.

If the item is taken after the courier has delivered it, this is treated as theft after delivery, which:

  • is outside our control,

  • is not caused by a service failure from us or the courier, and

  • must be reported to the police by the customer.

In these cases, we cannot refund or replace the parcel.

5.5 Delivery Disputes

If you believe a delivery error occurred, you must:

  • Report it to us within 30 days of the order date,

  • Provide any requested information so we can investigate with the courier.

After 30 days, we cannot guarantee courier investigations or compensation.


6. Products & Services

Some products may be limited in quantity. Returns are accepted only according to our official Returns Policy.

Colours may appear differently depending on the device or monitor used.


7. Billing & Account Information

You agree to provide accurate and up-to-date billing, contact and address details.

We may cancel or limit orders at our discretion. If this happens, we will notify you.


8. Third-Party Tools & Links

Our site may include tools or links provided by third parties. We are not responsible for their content, terms, or privacy practices.


9. User Comments

Any content you submit (reviews, comments, suggestions) may be used by us without obligation.

You must not submit unlawful, offensive, or misleading content.


10. Personal Information

Handled according to our Privacy Policy.


11. Errors & Corrections

We may correct errors (including pricing errors) at any time. Orders may be cancelled if they rely on incorrect information.


12. Prohibited Uses

You may not:

  • Break the law

  • Harass or harm others

  • Submit false information

  • Upload viruses

  • Interfere with site security

We may suspend service if you violate these terms.


13. Limitation of Liability

Nothing in these Terms affects your statutory rights.

To the fullest extent allowed by UK law, Oswin Hyde is not liable for:

  • Losses arising from courier safe-place delivery

  • Theft after delivery is confirmed

  • Indirect or consequential losses

  • Service interruption or technical issues

Our maximum liability is limited to the price paid for the product.


14. Indemnification

You agree to indemnify Oswin Hyde if your misuse of the site results in legal claims.


15. Severability

If any part of these Terms becomes unenforceable, the remaining sections still apply.


16. Termination

Either party may end this agreement. You remain responsible for all charges up to termination.


17. Governing Law

These terms are governed by the laws of England & Wales.


18. Changes to the Terms

We may update these Terms at any time. Continued use of the site means you accept the changes.
